Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Better Gym platform, including the mobile application, Progressive Web App (PWA), gym management backoffice, and all related services (collectively, the "Service") operated by Better Gym ("we", "our", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Definitions

• "User": Any individual who creates an account on Better Gym to track workouts, view metrics, or participate in gym activities.
• "Gym": A fitness establishment that subscribes to the Better Gym platform for gym management.
• "Gym Staff": Owners, administrators, and trainers authorized by a Gym to manage operations through the platform.
• "Content": Any data, text, images, routines, or other materials uploaded or generated through the Service.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You must verify your email address before your account is activated.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may sign in using email/password, Google OAuth, or Apple Sign-In.
• You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to create an account.
• You are responsible for all activity that occurs under your account.

3. Use of the Service

3.1 For Users (Free)

The Better Gym app for individual users is free of charge. As a User, you may:

• Create and manage your fitness profile
• Log workouts, track exercise records, and view fitness metrics
• View and follow routines assigned by your trainer
• Register for gym activities and classes
• Receive push notifications and announcements
• Belong to multiple gyms simultaneously

3.2 For Gyms (Subscription)

Gym management features require a paid subscription. As a Gym subscriber, you may:

• Manage members, trainers, and staff with role-based permissions
• Create and assign workout routines
• Manage exercise catalogs and categories
• Schedule and manage activities and classes
• View member metrics and analytics
• Configure gym settings, schedules, and branding

4. Subscriptions and Payments

• Gym subscriptions are billed on a recurring basis (monthly) through our payment provider, TicketEasy.
• All plans include a 14-day free trial with full access to all features. No credit card is required for the trial.
• Prices are displayed in the applicable currency at the time of subscription.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• After cancellation, your data is retained for 90 days. You may export your data or reactivate your account during this period.
• We reserve the right to change pricing with 30 days advance notice. Changes apply to the next billing cycle.
• Failed payments will be retried. After repeated failures, your subscription may be suspended.

5. User Content and Data

• You retain ownership of all Content you upload or create on the Service.
• By uploading Content, you grant us a limited license to store, display, and process it solely for providing the Service.
• You are responsible for ensuring your Content does not violate any laws or third-party rights.
• We may remove Content that violates these Terms without prior notice.

6. Gym Staff Responsibilities

Gyms and their authorized staff agree to:

• Use member data only for providing fitness and gym management services.
• Not share, sell, or misuse member personal data or fitness records.
• Properly configure role-based permissions to protect member privacy.
• Moderate announcement comments and activity communications appropriately.
• Comply with all applicable data protection laws regarding their members' data.

7. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Upload malicious content, malware, or harmful code
• Interfere with the Service's operation or infrastructure
• Scrape, crawl, or use automated tools to extract data from the Service
• Impersonate another person or entity
• Use the Service to send spam or unsolicited communications
• Resell, sublicense, or commercially exploit the Service without authorization

8. Health and Fitness Disclaimer

Better Gym is not a medical device, healthcare provider, or substitute for professional medical advice.

• Fitness metrics, predictions, and recommendations provided by the Service are estimates based on mathematical formulas (Epley, Brzycki, Lombardi) and are intended for informational purposes only.
• Recovery times, injury risk scores, and fatigue indicators are approximations and should not be used as the sole basis for training decisions.
• Always consult with a qualified healthcare professional or certified trainer before starting or modifying any exercise program.
• We are not liable for any injury, health issue, or adverse outcome resulting from the use of information provided by the Service.

9. Intellectual Property

• The Better Gym name, logo, design, and software are our intellectual property.
• You may not copy, modify, distribute, or create derivative works from any part of the Service.
• Exercise databases, metric formulas, and algorithm implementations are proprietary.

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may perform maintenance, updates, or modifications that temporarily affect availability.
• We are not liable for data loss or service interruptions caused by circumstances beyond our reasonable control.

11. Account Termination

• You may delete your account at any time. Account deletion permanently removes all associated data (profile, exercise records, sessions, notifications, device tokens).
• We may suspend or terminate accounts that violate these Terms.
• For Gym accounts, termination follows the data retention policy described in section 4.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not warrant that the Service will be error-free, secure, or uninterrupted.
• We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Better Gym from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Better Gym operates. Any disputes arising from these Terms shall be resolved in the competent courts of that jurisdiction.
